Summary

Defra has consulted (to Feb 2007) on options for implementing the Environmental Liability Directive (2004/35/EC) in England, Wales and Northern Ireland.

The Directive is intended to give effect to the "polluter pays" principle, by imposing liability for the prevention and remediation of environmental damage.

Defra intends to launch a second consultation on draft legislation in Autumn 2007.

The Directive was required to be implemented in Member States by 30 Apr 2007.
