Corporate responsibility for litter

Summary

Defra consulted (to May 2007) on proposals to widen the range of premises which face Street Litter Control Notices to include (1) all types of eating and drinking venues, and (2) office buildings. This gives local authorities the power to require the occupiers or owners to clear up litter in the immediate area of their premises (including that created by their employees, customers, suppliers or other visitors) and to install disposal facilities, or risk a fixed-penalty notice of up to £110.

Discarded cigarette ends are subject to the extended power, after specifically being classified as litter under the Clean Neighbourhoods and Environment Act 2005.

The extended power came into force on 1 July 2007 for all food and drink outlets; however, the change in respect of offices requires amendment to primary legislation, and will be introduced via a suitable Bill when parliamentary time permits.
