Summary

After earlier plans for a planning gain supplement (PGS), payable on the start of any development (residential or non-residential) following grant of planning permission, were shelved, the Department for Communities and Local Government (CLG) included provisions to introduce a Community Infrastructure Levy (CIL) in the Planning Bill (now Act), on the basis that local communities would receive significantly more of the benefit. The Planning Act 2008 received Royal Assent in Nov 2008.

CLG published explanatory materials on CIL (in Jul and Aug 2008), and stated its intention to consult on the design of the levy before the end of 2008. CIL Regulations, referred to in the Act, will not come into force before Spring 2009.
